3. Our Services

  • Clients pay a fee to access and use the system, while subscribers who receive emails do not pay.

4. Client Responsibilities

  • Clients are responsible for the content they create, upload, or send using our system.
  • Clients agree to comply with all applicable laws, including anti-spam regulations such as CAN-SPAM.
  • Clients may not use ePak to send illegal, misleading, or harmful content, or to harass or deceive others.
  • Any misuse of our tools, including sending unsolicited bulk emails or spam, may result in immediate suspension or termination of service.

5. Subscriber Information

  • Subscribers who sign up for emails through ePak campaigns are providing consent to receive marketing communications.
  • We respect all unsubscribe requests and ensure recipients can easily opt out at any time.
  • We do not sell or share subscriber data outside of the intended marketing purposes authorized by the subscriber or client.

6. Payments and Billing

  • Clients pay subscription or usage fees as stated at the time of registration or in their account settings.
  • All fees are non-refundable unless otherwise stated in writing.
  • Failure to make payment may result in suspension or termination of access to the system.

7. Intellectual Property

  • All content, designs, code, and features within ePak belong to us or our licensors.
  • Clients retain ownership of the content they create and upload but grant us permission to store, display, and process it as needed to provide our services.
  • You may not copy, resell, or modify any part of the platform without our written consent.

8. Limitation of Liability

  • We strive to keep our services running smoothly, but we do not guarantee uninterrupted access or error-free performance.
  • We are not liable for any direct or indirect damages arising from your use of our services, including lost profits, data loss, or business interruptions.
  • Our total liability will not exceed the total amount you paid for your subscription during the past 12 months.

9. Termination

  • We reserve the right to suspend or terminate any account that violates these terms or engages in abusive or fraudulent behavior.
